Terms of Service

The service

Servicr is software for field service businesses: scheduling, dispatch, job execution, invoicing, payments, client communications and related tools. Servicr is currently in private beta; features may change, and access to the service is subject to a separate customer agreement or order.

Accounts

You are responsible for your users, for keeping credentials secure and for all activity under your account. Tell us immediately at info@servicr.com about any unauthorized use.

Your data

You own the data you and your users put into Servicr, including your clients’ information. You give us permission to host and process it only to provide, secure and support the service. You are responsible for having the right to collect it and for its accuracy. See our Privacy Policy.

Acceptable use and messaging

We may suspend messaging or accounts that break these rules or put the service or other customers at risk.

• Send emails and text messages only to people who have given the consent required by law, and honour opt-outs immediately.
• Identify your business in every message and keep messages relevant to the services you provide.
• Comply with Canada’s Anti-Spam Legislation (CASL), the U.S. TCPA, CTIA guidelines, carrier rules and privacy laws that apply to you.
• Do not use Servicr for unlawful, deceptive, harassing or abusive content, to send purchased or rented lists, or to interfere with the service or its security.

Text messages (SMS)

Businesses that use Servicr can text their clients through the Servicr notifications program: appointment confirmations and reminders, “on my way” notices, service updates, invoices, payment links and receipts. Clients opt in separately, with optional consent that is never a condition of purchase; see how clients opt in.

Message frequency varies, typically 1 to 6 messages per service visit. Message and data rates may apply. Reply STOP (or ARRET) to any message to opt out, and HELP (or AIDE) for help, or write to info@servicr.com. Carriers are not liable for delayed or undelivered messages.

Fees

Paid plans, prices and billing terms are set out in your order. Founding-member pricing, where offered, applies for as long as the account stays active on that plan.

Intellectual property

Servicr, its software, design and brand belong to Technologies Servicr S.E.N.C. These terms do not give you any right to them other than using the service.

Availability and warranty

We work to keep Servicr available and secure, but the website and beta service are provided “as is”, without warranties to the extent permitted by law. Nothing in these terms limits rights you have under the Québec Consumer Protection Act, where it applies.

Liability

To the extent permitted by law, Servicr is not liable for indirect or consequential damages, lost profits or lost data, and our total liability is limited to the amounts you paid us in the 12 months before the claim.

Ending use

You may stop using Servicr at any time. On request, we return or delete your data as described in the Privacy Policy.

Governing law and language

These terms are governed by the laws of Québec and the federal laws of Canada that apply there, and disputes go to the courts of the judicial district of Montréal. These terms are available in French and English; the parties have expressly requested that they be drawn up in both languages.

Changes

We may update these terms and will post the new version here with its date. Material changes are notified to customers in advance.
